Licking County jury finds Fogle guilty of assault, firearms charges

A Licking County jury found Tracy Fogle guilty on June 12 in the assault of a family member and her boyfriend with a firearm at their home. The incident concluded with one of the victims hitting Fogle with a car.

According to a press release from Licking County Prosecuting Attorney Jenny Wells, Fogle was sentenced to an indefinite prison term of five to seven-and-a-half years after being found guilty of felonious assault with a firearm, improperly handling a firearm in a motor vehicle while intoxicated, aggravated menacing, and a firearm specification for displaying and using the weapon.

Wells said that Fogle drove to the family member's house on August 23, 2024, to confront her about asking another relative to bring water. The defendant brought two firearms, four magazines, and 50 additional rounds of ammunition. Wells noted that Fogle displayed a firearm to the victim, who then left the property with her boyfriend to avoid confrontation.

When the victim and her boyfriend returned home several hours later, according to Wells' release, Fogle was still on the property and was drinking. Upon being asked to leave, she assaulted her family member physically and pointed a firearm at the victim. When attempting to use the firearm on the victim, the victim's boyfriend revved his vehicle's engine. Fogle then pointed the firearm at him and attempted to fire. In response, he drove forward and struck Fogle before they proceeded to seek assistance at a local fire department.

The release further mentioned that Fogle had twice the legal level of alcohol and above-legal levels of THC in her system at the time. She admitted to detectives from Licking County Sheriff's Office that she intended not to leave until her victim agreed to accompany her. The jury delivered its guilty verdict on day three of the trial.

Licking County Assistant Prosecutor Clifford Murphy tried the case. The investigation and testimony from members of the Licking County Sheriff's Office were pivotal in securing this outcome. Key figures included lead detective William Bowman, Detective Shane Rockey, Deputies Kameron Brown and Ryan Donahue, as well as Central Ohio Regional Crime Lab Criminalist Eric Fashano.
