NOTICE OF FORFEITURE
Notice of Intent to Cancel Oil and Gas Lease Under Ohio Revised Code Section 5301.332 Notice to Mark Producing, Inc. and successors or assigns: Pursuant to Section 5301.332 of the Ohio Revised Code, you are hereby given notice that the Oil, Gas, and Mineral Lease dated June 29, 1983, by and between Frederick D. Wade and Kathryn A. Wade (as lessors) and Mark Producing, Inc. (as lessee), recorded August 8, 1983, in Volume 85, Page 217-219 of the Knox County, Ohio Recorder’s lease records (the “Lease”), concerning certain real property in Hilliar Township, Knox County, Ohio, comprising approximately 398.786 acres, more or less (the “Leased Premises”), of which approximately 85.407 acres (the “Property”) are now owned by Thistlegate 16 LLC, an Ohio limited liability company (the “Company”), is subject to forfeiture for the following reasons: (i) the 5 year term of the Lease has expired; (ii) there are no producing or drilling oil or gas wells on the Leased Premises; (iii) no operations in search of oil or gas have been conducted on the Leased Premises; and (iv) the Company has not received consideration required to maintain the Lease in force. If you do not have the Lease released of record within thirty (30) days from the date of publication of this Notice, the Company intends to file an Affidavit of Forfeiture with the Knox County, Ohio Recorder, pursuant to R.C. 5301.332.
