MOUNT VERNON — A Knox County judge improperly applied Miranda rights to a ruling that found evidence in an alleged vehicular assault case not admissible at trial, according to an appeal filed by Knox County Prosecuting Attorney Chip McConville.

In an appeal filed Jan. 25, McConville writes that Common Pleas Court Judge Richard Wetzel based his ruling on a Miranda issue after Miranda was waived as a challenge in a Nov. 9 motion to suppress hearing. The appeal is filed in a court case that brought charges of aggravated vehicular assault and OVI against Mckenzie R. Phillips, 20, Mount Vernon.
