MOUNT VERNON — Counsel for the Mount Vernon City school board on Friday filed a memorandum in opposition to John Freshwater’s motion asking the Ohio Supreme Court to reconsider its opinion.
Freshwater was fired from his position as eighth-grade science teacher in January 2011, for insubordination and for inserting his personal religious beliefs into classroom instruction. He appealed to the local trial court and the Fifth District Court of Appeals, both of which ruled that Freshwater was defiant and insubordinate, confirming his contract termination was justified. The appeal eventually ended up in the Supreme Court of Ohio, which heard oral arguments this past February. On Nov. 19, the Court upheld the school board’s action. On Nov. 25, Freshwater’s attorneys filed a reconsideration motion.
