MOUNT VERNON — Mount Vernon Police Department Patrolman Brian Weiser has been suspended for two days as a result of the accident July 5 at Mulberry Street and Ohio Avenue.
Capt. George Hartz, acting police chief, told the News this morning he issued an order Friday suspending Weiser for two days for not wearing his seat belt and for generally operating a vehicle in an unsafe manner.
Hartz said there was precedent for the disciplinary action, noting three previous cases in the department’s records in which the officer involved received a two-day suspension.
Action in this case had to wait until now because the city was waiting for the Ohio Highway Patrol’s reconstruction of the accident, in which Weiser’s cruiser was hit in the intersection and rolled over. He was responding to an emergency call to the Mental Health and Recovery Center on Blackjack Road.
City Law Director Chip McConville said after studying the report there was no clear basis for citing Weiser for traffic violations.
Hartz said decisions on any citations against the driver of the other vehicle involved in the accident would come from the patrol.
